This is a complaint filed by one Chhabi Bibi of Hazipur. The complaint against the Station Manager, WBSEDCL, Mollarpur Customer Care Centre is that the complainant applied for electric service connection in her sub-mersible pump for improvement of irrigation at her agricultural land. The O.P party inspected the spot and having been satisfied sent quotation to the complainant. The complainant deposited quotational amount of Rs. 7267/- on 29.12.2015. Inspite of receiving quotational amount and other documents as per requirement the O.P did not effect the electric service connection to the SMP of the complainant. The complainant went to the O.P and requested him for effecting the electric service connection in her SMP. But the O.P did not pay any heed. Being deprived from service connection the complainant has come to the Forum for justice.
The O.P on receiving notice from the Forum has appeared and contested the case by filing written version. The O.P stated that the complainant did not file the required NOC. As the service connection was required of four PCC poles by which LTOH line will be drawn to cover 200 meters length. The NOC from land owner submitted by the complainant is not sufficient. In this regard an intimation of way leave problem was given to the complainant. But she did not file proper way leave certificate. The O.P is ready to effect electric line to the SMP of the complainant if she complies the requirement of way leave.
Decision with reasons
Admittedly the complainant applied for new connection to her submersible pump which demands load of 5HP. The O.P inspected the spot on the basis of application submitted by the complainant and issued a provisional quotation being No. 5001072207/QUOT/03 dated 13.12.2015 to the complainant. The complainant deposited quotational amount at the office of the O.P vide money receipt No. 127501651323 dated 29.12.2015 of Rs. 3267/- and money receipt No. 130401651075 dated 29.12.2015 amounting to Rs. 4000/-.
The O.P did not connect the said service line though the complainant complied all the formalities

as per requirement by the O.P. The O.P raised objection that the complainant was severally informed to submit way leave / no objection certificate from other land owners on whose land the service connection line would be drawn. The service connection was required 4PCC poles along with all other associated materials by which a new LTOH line of length of 200 meters approximately will be drawn.
Perusing all the documents and evidence in chief submitted by the complainant the Forum notices the complainant has admitted in cross examination that “it is fact that way leave submitted by me was not sufficient” and also admitted that “we received letter dated 05.02.2016 from the O.P alleging that my way leave was not sufficient.”
So, evidently proved that the O.P could not draw service line due to insufficient way leave. The complainant was repeatedly directed to submit proper way leave but she did not comply it.
Therefore the Forum opines that the O.P has no deficiency in service.
Proper fees have been paid.
Hence,
O R D E R E D
that C.F case No. 69/2016 be and the same is dismissed on contest. The complainant is given liberty to file no objection certificate as required by the O.P and the O.P will connect service line to SMP of the complainant. No order as to cost.
Copy of this order be supplied to the parties each free of cost.
