ORDER

The record is taken up for admission hearing.

Heard perused the complaint and documents.

We find prima facie case.

Let it be admitted.

The complainant filed an ad interim petition, taken up for hearing and the same be treated as M.A No. 03/2021.

That the complainant is the resident of Vill. Husnabad Pelpara, P.O.+P.S. Suri, Dist. Birbhum within the Jurisdiction of this Ld. Forum.

That the Op. Company Limited is situated at Suri Benepukurpara, under P.S. Suri, in the District of Birbhum under the jurisdiction of the Learned Commission.

That your petitioner/complainant is a bonafide consumer of the above named OP and having a domestic electric connection for his residential purpose vide Consumer ID No. 500610597, Meter No. HR 072385.

That as bonafide consumer of the OP the petitioner/complainant had being paying the Bill/s amount according to his family consumption before lock-down but due to financial crises the above named petitioner/complainant has failed to pay the Electric Bill last few months and the outstanding Bill amount of the petitioner/Complainant is now Rs. 4617.46/- including gross demand which has been revealed from the Electric Bill for the period of December, 2020 to February, 2021.

                                                                                          

 

That on 22/12/2020 the agent/person of the OP without servicing any reminder notice to the complainant/petitioner forcibly disconnect the electric connection of the complainant/petitioner though complainant/petitioner requested to the person/agent of the OP not to disconnect the said electric connection and promised that he shall pay 50% of outstanding bill amount but in spite of rendering proper services towards its customer/consumer the OP Company Ltd disconnect the said electric connection and showed sheer negligence and deficiency of their service.

That since after disconnection the complainant/petitioner as well as his family members have been staying in a dark condition and the children of the petitioner, who are the student cannot able to conduct their study properly.

On 22/12/2021 of the OP without servicing any reminder notice to the complainant/petitioner forcibly disconnect the electric connection of the complainant/petitioner.

            At the stage without going in to the merit of the case we think that electricity is an essential part of modern human life in the present day situation and the complainant is very much suffering of the situation we think ends of justice would met up if the complainant is directed to pay lump sum amount to OP and OP is directed to reconnection/restoration the line.

            Accordingly prayer is allowed of the complainant.

Hence,

            Ordered,

                        that the ad interim petition filed by the complainant i.e. M.A No. 03/2021 is allowed. The complainant is directed to deposit Rs. 4617.46/- to the OP W.B.S.E.D.C.L, Suri Benepukurpara, within 7 days from the day of this order and OP is directed to reconnect the electric connection of the complainant being ID No. 500610597, Meter No. HR 072385 immediate after payment of Rs. 4617.46/-.

            Deposited amount will be adjusted with Electric Bill of the complainant.

            The complainant is also directed to pay the current Bill month by month/quarterly.

Thus the M.A. disposed of accordingly.

Copy of this order be supplied to the complainant free of cost.

A copy of this order be sent to the O.P through Speed Post for compliance

To 29.04.2021 for S/R of notice, appearance, W/V, W/O and hearing of ad interim petition.
