The case is fixed for argument. After hearing argument from both sides the commission proceeds to dispose of the case as here under.
The complainant’s case is that he is a consumer no A100108 originally under Sarenga Electric supply and thereafter under O.P. There was no problem of billing under Sarenga Electric supply. But since Feb 2012 to April 2014 the complainant did not receive any electric bill for payment. All on a sudden he received a demand notice dated 17/05/2014 from O.P for Rs-149901/= as the outstanding dues for the bill period 2/2012 to 4/0214. The complainant has come before this commission challenging the said demand notice and the electric bills for the period 02/2012 to 04/2014.
O.P contested the case by filing a W.V admitting there in their deficiency in sending regular electric bills during the dispute period. However the demand notice in question is based on actual. Consumption of units and the complainant cannot avoid the payment of outstanding dues.
Decision with reason
Having regard to the facts to the case contention, submission, and documents on both sides the commission finds that OP had at the material time some administrative problem in sending electric bill to the consumer.
Accordingly the O.P had to send the demand notice dated 17/05/2014 for Rs-149901/=during the disputed period. At the time of hearing Ld.Adv. for the complainant frankly submitted that the complainant is ready and willing to pay 50% of outstanding dues together with payment of current electric bill. Ld.Adv. for the O.P though has raised objection but could not justify the outstanding due in the demand notice.
Considering the facts and the circumstance of the case and status of the complainant the commission thinks it just and proper to direct the complainant to pay to the O.P Rs-75000/= towards the outstanding due of demand notice dated 17/05/2014.
The complainant will however go on depositing payment of current bill as usual.
Hence it is ordered.
The case is disposed of on contest by directing the complainant to pay to the O.P Rs-75000/= towards the demand notice dated 17/05/2014 in ten monthly equal installments together with deposit of current electric bill from time to time regularly.
Both parities be supplied copy free of cost.
