Both parties file hazira through advocate.

The case is fixed for Argument. After hearing Argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case in brief is that he successively on 20/11/2014, 31/12/2014, 19/01/2015 and lastly on 27/01/2015 applied for electric connection to his Submersible Pump for irrigation purposes but on each occasion he received objection letter from the O.P. Authority mainly on the ground that criminal case is pending with regard to the Submersible Pump on the self same Plot in the name of his father Mrityunjoy Singha u/s 135 of the Electricity Act and also showing demarcation dispute of the said Plot between the Complainant and his brother Sanjib Singha. Being frustrated and getting no relief from the O.P. Authority the Complainant has approached this Commission for installation of electric connection to his Submersible Pump with penalty as per law.

The O.P. contested the case by filing a written version stating clearly in Para 8 of the written version that the electric connection has already been effected to the Submersible Pump of the Complainant on 19/07/2016 and the electric bill was duly raised and paid by the Complainant.

-: Decision with reasons: -

Having regard to the facts of the case, contention, submission and documents on record the Commission finds from the written version and the statement of fact filed by the O.P. on 08/08/2018 before this Commission that electric connection to the Submersible Pump has already been effected on 19/07/2016 and as such the Complainant has no locus standi to proceed with this case. It further reveals from the materials on record that the O.P. did not get any clearance for giving electric connection to the Complainant firstly because of the pendency of the criminal case under the Electricity Act in the name of his father Mrityunjoy Singha over the self same Plot of land and after verification of this matter the dispute arose with regard to the demarcation of the said Plot of land between the Complainant and his brother Sanjib Singha and after obtaining consent from his brother the O.P. proceeded to install the electric connection as prayed for without further delay. So the question of penalty does not arise in this case.

Hence it is ordered……..

That the instant case is disposed of accordingly without any order as to the compensation as the Complainant has already got the electric connection.

Both parties be supplied copy of this Judgement free of cost.
