The case record is put up before this Commission, today on the prayer of the Ld. Advocate for the complainant/petitioner.
The petition U/S 38 of the C.P Act 2019 as filed by the complainant be treated has been registered and treated as M.A being No. 14/2022.
The complainant/petitioner files this petition U/S 38 of the C.P Act 2019 alleging interalia that the OP/W.B.S.E.D.C.L sent the exorbitant bill for running submersible pump by the consumer/complainant having Consumer ID No. 501721943. It is further stated that complainant used to pay all the electric bills sent by the OP except the bill in question dated 20/05/2022 amounting to Rs. 1, 68,175/- only which is exorbitant and impossible. It is also the allegation of the complainant that the electric meter is defective one and the OP did not replace the same even on even on repeated request. Which compelled the complainant to file this case being CC/56/2022.
Under compelling circumstances the petitioner/complainant files the U/S 38 C.P Act 2019 apprehending that the OP will disconnect the electricity connection of the complainant. So, the instant prayer for interim injunction has been filed by the complainant/petitioner with a prayer to direct the OP not to disconnect the electricity connection of the complainants Consumer ID No. 501721943.
In view of the facts circumstances of the case as stated by the complainant in his petition U/S 38 of the C.P Act 2019 and the petition of complaint and also considering the balance of convenience and inconvenience, irreparable loss and injury it is found that there is strong prima facie case in favour of the complainant. So, the complainant is entitled to get relief as prayed for.

Ordered,
that the petition U/S 38 of the C.P Act 2019 as filed by the petitioner/complainant is here by allowed exparte.
The OP/WBSEDCL is here by restrained from disconnecting the electricity connection by the complainant of his Consumer ID No. 501721943 till 11/08/2022.
The M.A Case No. 14/2022 is thus disposed of.
To date complainant/petitioner is directed to serve the notice regarding the interim injunction upon the OP at once.
