This is a complaint under section 12 of the CP Act, 1986.
One Urfan Sekh (here in after referred to as the Complainant) filed the case against Station Manager, WBSEDCL, Jalangi CCC (here in after referred to as the OP) praying for compensation alleging deficiency in service.
The material facts giving rise to file the complaint are that:-
The Complainant, namely, Urfan Sekh is the consumer to the OP having Consumer ID No. 312281060 and installation No. 13992355.
The Complainant stated in his plaint that he had paid all his dues with present bill dated 23.08.16 and 03.11.16. Thereafter the OP has sent a bill for the month of February, March and April,2017 amounting to Rs. 3,576/-. It is alleged by the Complainant that the said bill is fictitious and illegal and the Complainant is not bound to pay the said bill amount.
He prays for cancellation of the bill for the month of February, March and April, 2017 issued by the OP, Station Manager, WBSEDCL, Jalangi CCC.
Notice was issued upon the OP but the OP did not turn up in spite of receiving the said notice and as such the case is being proceeded ex-parte.
Decision with Reasons:
Ld. Adv. for the Complainant is present. He is asked by this Commission to show the disputed bill i.e. the electric bill for the month of February, March and April, 2017. But the Ld. Adv. for the Complainant fails to show the said disputed bill. Thereafter, he fairly submits before this Commission that the Commission passes necessary order.
After hearing the Ld. Adv. for the Complainant and considering the materials on record we are of the view that the instant case is liable to be dismissed.
Reasons for delay
The Case was filed on 18.02.19 and admitted on 26.02.19. This Commission tried its level best to dispose of the case as expeditiously as possible in terms of the provision under section 13(3A) of the CP Act,1986. Delay in disposal of the case has also been explained in the day to day orders.
In the result, the Consumer case fails.
Fees paid are correct. Hence, it is

that the instant Case No. CC/20/2019 be and the same is hereby dismissed on merit without order as to costs.
