ORDER

Today is fixed for petition of interim hearing U/S 13 3(b) CP Act.

            Considering urgency the record is taken up for hearing.

            The application filed by the complainant against the OP W.B.S.E.D.C.L for passing interim order U/S 13 (3B) CP Act 1986 is taken up for hearing treating the same as M.A Case No. 21/2019.

            Heard both sides. The OP W.B.S.E.D.C.L has contested the application without filing any formal objection.

            It is the case of the complainant that he is an agriculturist and consumer being ID No. 500656398. under OP W.B.S.E.D.C.L. The complainant has a submersible pump in his agriculture land to irrigate. The complainant used to run his submersible with the help of electricity which is supplied by the Op.

            The complainant used to maintain his livelihood from the usufructs of his agriculture land and he has no other source of income except the income derived from the use usufructs of the articulate land.

             The complainant runs his aforesaid submersible pump through electricity supplied by the Op, having its service connection being consumer ID. No. 500656398.

 The complainant has been paying electric bills regularly so far bills were sent by the OP except the bill dated 06/04/2018 of Rs. 10,689/- which is an exorbitant bill.

            It will be revealed that the said bill has been raised due to defective meter.

            We find that there is defect in his meter being no -SX009910 and he informed the same in writing to the OP W.B.S.E.D.C.L to replace the defective meter. In spite of that the OP did not replace the said meter till today.

            The petitioner several time requested to OP W.B.S.E.D.C.L about the defective meter and exorbitant bills of Rs. 10,689/- on 06/04/2018 and the Complainant submitted written representation on 16/04/2018 before the OP and requested to quash the bill dated 06/04/2018 before the Station Manager

 

i.e. Op and to change the mater and raised fresh bill but all are in vain. 

            Hence this application for passing interim order of against the Op for not to disconnect the electric line of the Complainant.

On careful scrutiny of the record and documents filed by the complaint we find substance that the complainant has got an exorbitant eclectic bill of Rs. 10,689/- which is very much more than his average eclectic bill.

            At this stage without going into the merit of case we think electricity is most essential part of the human life in the present day situation and as the complainant has been earning his livelihood from said submersible pump we think ends of justice would be met up if the Complainant is directed to pay lump sum amount to O.P is to direct not to disconnect the line.

 Accordingly prayer for interim order is allowed.

The Complainant is direct to deposit Rs. 2,000/- to the O.P W.B.S.E.D.C.L Mollarpur, Mayureswar, Birbhum within 7 days from this day and the O.P is directed not to disconnect the Electric Connection of the Complainant being ID No. 500656398 after payment of Rs. 2,000/- and also to directing the OP to install a new defect free meter/ Check meter to get proper consumption.

            Deposited amount will be adjusted with Electric Bill of the Complainant.

            The Complainant is also directed to pay the current Bill month by month/ quarterly.

Thus the M.A is disposed of.

 Fixed 03/04/2019 for W/V filing by the O.P.

Interim order will be effective till 03/04/2019.

            The Copy of the order be sent to O.P W.B.S.E.D.C.L, Station Manager, Mollarpur, Mayureswar, Birbhum through speed post for Compliance.

            Copy of this order be supplied to the parties each at free of cost.
