The application dated 24/07/2018 filed by the Complainant Bijay Mondal against the O.P W.B.S.E.D.C.L for passing interim order under section 13 CP Act 1986 is taken up for hearing treating the same as M.A Case No. 79/2018.
Perused the Complain, interim application and document. Heard Ld. Advocate/agent of Complainant.
This is the case of Complainant Bijay Mondal that his deceased father Kartick Ch. Mondal had Electric Connection being Consumer I/d No. 5022011199 in his premises under W.B.S.E.D.C.L.
The Complainant being beneficiary and son of deceased Kartick Mondal has been enjoying Electricity there by paying Electric Bill regularly. But the O.P sent illegal and exorbitant Bills of Rs. 32,936.5ps/- and Rs. 35,807.69ps/- for the month of June and July 2018 respectively.
This the further cases of Complainant that on 11/06/2018 and 25/06/2018 submitted written representation before O.P but no effect.
Then he lodged a Complainant before RGRO and RGRO received Complainant on 04/07/2018 but no date of hearing is fixed as yet.
Rather O.P W.B.S.E.D.C.L threatened him that they will disconnect the line if outstanding amounts are not paid.
Copy of the Bill shows that Rs. 68,741/- was claimed form the Complainant and copy of the masses shows that is Electric Connection is to be disconnected within 27/02/2018, if he fails to pay Bill.
In this juncture without going into the merit of the case we think Electricity is most essential part of the Human life in the present day situation. More so the Complainant is depending upon the present industrial line for has livelihood.
We think ends of justice would be met up if the Complainant is directed to pay lines lump sum amount to O.P and O.P is to direct not to disconnect the line. Accordingly prayer for interim order is allowed.
The Complainant is direct to deposit Rs. 15000/- of the O.P the W.B.S.E.D.C.L within 7 days from this day and the O.P is directed not to disconnect the Electric Connection of the Complainant being i/d No. 5022011199 till 30/08/2018.
Deposited amount will be adjusted with Electric Bill of the Complainant.
The Complainant is also directed to pay the current Bill month by month/ quarterly. Fixed 30/08/2018 for appearance to O.P.
The copy of the order be supplied the parties at free of cost.
