Both parties file hazira through advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder:-

The Complainant’s case is that he has a billing dispute for the Bill Period from 09/2013 to 11/2013 out of which the Complainant has already deposited on protest Rs.1,703/- under proper receipt. The Complainant has approached this Commission challenging the aforesaid bill with appropriate relief.

The O.P. contested the case by filing a written version/written argument wherein it has been stated that the Complainant is to pay the balance of Rs.3,183/- towards the outstanding dues.

-: Decision with reasons: -

At the time of hearing the Complainant has submitted before this Commission that he is not ready and willing to pay the balance outstanding dues towards the disputed bill but the Ld. Advocate for the O.P. has contended that the disputed bill has been raised taking into consideration the previous average consumption and as such the Complainant must pay the balance amount.

Considering the long pendency and the facts and circumstances of the case the Commission is of the view that the Complainant should pay Rs.1,000/- to the O.P. towards the outstanding dues of the aforesaid disputed bill.

Hence it is ordered……..

That the case be and the same is allowed on contest in part but without cost.

The Complainant is directed to pay to the O.P. Rs.1,000/- further towards the aforesaid disputed bill i.e. from 09/2013 to 11/2013 or to adjust the same with the current bill if possible within one month from this date in default law will take its own course.

Both parties be supplied copy of this order free of cost.
