FINAL ORDER

 

            Sri Samaresh Kumar Mitra, Presiding Member.

 

            This Execution Application has been arisen out of CC 94/2013 for non-compliance of the final order passed on 28.11.2014.

            From the case record, it appears that from 14.09.16 the D.hr was found to be absent. Thereafter, several opportunities were given to the D.hr but on four consecutive occasions the D.hr were absent. No steps were taken by the D.hr. Thereafter, on 03.02.2017 the D.hr was show-caused as to why the instant Execution Application shall not be dismissed for non-prosecution but not such show-cause has been filed by the D.hr.

            In our opinion, the D.hr is not interested to proceed with the Execution Application and has been dragging the case day by day. It is presumed that his grievance has been redressed. So, we are of the view that the Execution Application should be dismissed for non-prosecution.

            Hence,

                                                           Ordered

that the Execution Application No. 03/2015 be and the same is hereby dismissed for non-prosecution.

 

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
