Order No.12 dated 12.09.2017

Both parties file hazirah, but none is present on behalf of the Dhr on repeated calls till 3:00 pm.

Hd. the Ld. Adv. for the Jdr. 

Ld. Adv. For the Jdr stated that the concerned complainant case has been dismissed on merit by the Forum, which is clearly revealed from perusing the Record thoroughly.

Thus considering the all aspects of the instant case, it is ridiculous that after dismissal of the CC Case on merit, the Dhr/Complainant has filed the Execution Case.

It is not understood that Dhr/Complainant has filed the Ex-Case for executing which ‘Order’ of the Forum, when the case is already dismissed on merit.

Moreover, it is revealed from the Record that after filing of the instant case the Dhr/Complainant either did not take any step or took step but none appear or present to move the matter.

So, perusing the entire record, it is clearly evident that this Ex-Case is not entertain able at all by the Forum.

Thus, the unanimous decision of the Forum is that the instant Ex-Case be and same is dropped and be disposed of finally.
