Today is fixed for filing questionnaires by the OP. OP files a petition for seeking time on the ground stated therein. No objection raised by the complainant’s side. Heard. Considered. Allowed as last chance for the sake of justice.
Complainant files another application U/S 38 of the Consumer Protection Act, 2019 for seeking interim relief is taken up for hearing and treating the same as M.A. Case No. 01/2023.
Perused the interim application and documents. Heard Ld. Advocates for both sides.
We find from the case record that an interim order being No. 13 was passed on 27/12/2022 directing the OP/WBSEDCL to restore electricity connection being Consumer ID No. 50026995 of the complainant within 4 days therefrom positively and also directing the OP to issue bill month by month/quarterly without generating the challenged bill or outstanding bill.
It is the submission of the Ld. Advocate for the complainant that the OP restored the electricity connection but refused to take current electric bill and OP violating the ad-interim order being No. 13 dated 27/12/2022 passed by this District Commission.
In this juncture without going into the merit of the case we think Electricity is most essential part of the human life in present day situation. Moreover, the complainant is depending upon the present electricity connection to run submersible pump situated at his agricultural land i.e. for his livelihood.
Hence, we think prayer is to be allowed.
Hence, it is,
ORDERED,
the petition dated 09/02/2023 filed by the complainant for direction upon the OP to receive the current bill except the disputed bill in some installments is necessary i.e. M.A Case No. 01/2023 is allowed on contest. No cost.
The OP/WBSEDCL is directed to issue fresh Electricity Bill being Consumer ID No. 50026995 from October, 2021 to December, 2022 i/d necessary order will be passed and the complainant is directed to pay the Electricity Bill raised by the OP in 6(Six) installments.
The complainant is also directed to pay Electricity Bill month by month/quarterly from January, 2023 as per consumption in respect of this service connection.
Thus the M.A. is disposed of.
Fix. 20/02/2023 for filing questionnaires by the OP as last chance. Interim order will be effected till the date.
Copy of this order be supplied to the parties each at free of cost.
