The case is fixed for argument..
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that he is a domestic Consumer under the O.P. vide Consumer I/D 233181629 and Meter No.L055553 but the Meter was found defective and the O.P. did not replace the same in spite of reminders and with such defective meter O.P. has been raising electric bill since 28/11/2014 till 17/03/2022 and the Complainant duly paid the same. But for the April, May, June Quarter an electric bill dated: 19/04/2022 for Rs.92,847/- has been sent upon the Complainant for payment. After receipt of such bill the Complainant has approached this Commission challenging the said bill as inflated and illegal claiming adequate compensation for the same.
O.P. contested the case by filing a written version but contending inter alia that the electric bill under challenge has been duly generated on the basis of consumption of the old meter and taking into consideration the defective meter the disputed bill has been reduced to Rs.56,810/- payable by the Complainant after adjustment of the consumption units already paid by the Complainant.

-: Decision with reasons: -
Having regard to the facts of the case, contention, submission and documents on both sides the Commission finds that the Complainant has a small family and their both sons are out of station and as such consumption as shown by the O.P. cannot be so high.
At the time of hearing Ld. Advocate for the O.P. has frankly submitted before the Commission that average consumption of the Complainant does not match with the disputed bill. On examination of the previous consumption bills the Commission finds that the Complainant has on an average consumption of electricity throughout the year which is proportionately lesser to the consumption units as shown in the disputed bill. So the disputed bill needs proper rectification.
Hence it is ordered…….
That the case be and the same is allowed on contest but without cost.
O.P. is directed to revise the disputed bill dated: 19/04/2022 according to actual consumption of the Complainant to be calculated from consumption of preceding and succeeding period and send the revised bill to the Complainant within a month from this date and after receipt of the revised bill the Complainant will pay the same within thirty days thereafter.
Both parties be supplied copy of this Order free of cost.
