Both parties file hazira through advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -

This is an application u/s 40 of consumer Protection Act, 2019 for review of the impugned order dated: 06/02/2023 passed by this Commission in C.C. No.79/2013 on the ground that the Commission has not correctly appreciated the Complaint case on merit.

Perused the impugned order and heard the Ld. Advocate on both sides.

At the time of hearing concerned Station Manager was present to assist the Commission. Ld. Advocate for the Complainant has referred to undisputed previous electric bills wherefrom it could be ascertained that the Complainant Establishment has an average consumption around 4000 Units per month but for the disputed period for January to March, 2013 the Consumption unit was abnormally shown as 2,25,788 Units from the preceding Quarter consumption 81,895 units. Ld. Advocate appearing for the O.P. has raised objection to adoption of any average means for assessment of the electrical consumption of the Complainant Establishment. The Commission has taken note of the consumption prior to the disputed bill and is inclined to determine the consumption at 12,000 Units for the disputed bill from January to March, 2013 by applying thumb rule and giving no scope of further controversy the Commission fixes the outstanding liability of the Complainant to pay to the O.P. Rs.1,00,000/- for the Consumption of the disputed bill.

Accordingly the Review application is allowed and the impugned order dated: 06/02/2023 is modified to the extent that the Complainant will pay to the O.P. Rs.1,00,000/- as lumpsum towards the electrical charges for 12,000 Units for the disputed bill from January to March, 2013 within one month from this date in default law will take its own course.

Both parties be supplied copy of this Judgement free of cost.
