The complainant has come up with the instant complaint against the OP with a prayer for direction upon the OP to connect electricity line to the house of the complainant and other relief on the principal ground that he deposited Security Money of Rs.239/- on 21.11.2014 and Rs.2000/- as Service Connection Charge as per direction of the OP, after his application for electricity connection to his dwelling house on plot no. 3786 under khatian no. 4953 of mouza Laksha under dist. Purba Medinipur, but the OP did not connect the electricity line to his dwelling house as applied for even after several request including written complaint before its Customer Care Center on 31.12.2014.

The OP appeared through his lawyer and resisted the complaint by filing Written Version wherein it is stated that as per work order the enlisted agency of WBSEDCL went to the spot several time to effect new service connection to the complainant’s house but due to physical resistance caused by one Dulal Chandra Das and other, the service connection could not be effected. The complainant has not yet submitted proper way leave before the OP inspite of issuance of written letter dtd. 14.01.2015 from the end of the OP to the complainant.

Decision with reasons

Both the parties filed their respective written notes on argument.

Heard both sides over the hearing of argument of the said case.

We have carefully gone through the pleadings of the parties as also the documents (photo copies) on record.

Admittedly the complainant applied on 11.11.2014 for domestic electricity service connection for his house before the OP and deposited on 21.11.2014 the total amount of RS.439/- before the OP as all service charge for such connection.

According to the OP, their enlisted agency went to the spot for several times to effect the said service connection but due to resistance by two persons, they could not effect the said service connection.

It is to be noted that no specific date has been mentioned in the W/V and/or in the WNA of the OP filed on record towards alleged resistance.

In our considered view, such alleged resistance cannot be a cogent ground for not effecting the service connection. It is the duty on the part of the OP to effect the service connection of the complainant since they have taken the money from the complainant for effecting such new domestic electric service connection to the premises of the complainant.

We feel that such inaction to effect the service connection to the house of the complainant is deficiency in service on the part of the OP. so, the complainant is entitled to relief as sought for.

Hence, it is,

Ordered

that the instant consumer complaint being no. CC-03/2015 be and the same is allowed on contest against the OP with cost of Rs.1000/-. The OP is directed to effect the electric service connection to the complainant within 40 days alongwith payment of cost of Rs.1000/- to the complainant from the date of passing this final order, failing which the complainant shall have the liberty to execute this order in which case fine of Rs.100/- per day shall be payable by the OP to the complainant till compliance of the above direction in toto.
