ORDER

The Record is taken up at the instance of the Complainant.

            The interim petition filed by the complainant is to be disposed of.

            Considering urgency the record is taken up for hearing.

            Perused the complainant and document.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                   Heard.

            We find prima facie case issue notice.

            The case be admitted.

            The application dated 26/12/2018 filed by the Complainant against the O.P No. 1 and 2 W.B.S.E.D.C.L for passing interim order under section 13 CP Act 1986 is taken up for hearing treating the same as M.A Case No. 150/2018.

            Perused the Complaint, interim application and documents.

Heard Ld. Advocate/agent of Complainant.

            It is the case of the Complainant that she is consumer being Id No. 522129250 under OP No. 1 and 2 W.B.S.E.D.C.L and a Mobile Message was sent to the Complainant on 14/12/2018 by the O.P No. 1 stating that an amount of Rs 38,198/- is due against her and unless the bill is paid by 28/12/2018 the power Supply shall be disconnected.

            We find that it is the case of the Complainant that he paid bill of Rs. 407/- for the month of March,   April and May 2018.

            It is the further case of the complainant that there is defect in her meter and she informed the same in writing to the OP No. 1 on several time.

            She further stated that in bill for the month of March, April and May 2018 previous reading was shown 0.00 unit and present reading was shown 80.00 unit, whereas in the yellow card the representative of OP noted the reading of above meter was 2830 unit on 30/08/2017 and 3619 unit on 29/05/2018 and for that the petitioner complained before the OP for abnormal reading and due to that reason OP connected a check meter vide No. G 01842227 to check the correctness of above meter on 13/09/2018 where in the check meter the reading was 1206 unit and in the above meter reading was 4394 unit and after 68 days the check meter and original above meter total reading was not tallied with each other, and it is clear that above meter is defective.

            She further stated that the OP sent a bill to the petitioner for June 2018 to August 2018 Rs. 33298/- where the meter reading shown as previous is 80 unit on 14/03/2018 and present is 3619 unit on 29/05/2018 and in connection with that OP sent two bills to the petitioner i.e. bill for September to November 2018 Rs. 38078/- and the last bill for December 2018 to February 2019 Rs. 40054/- which is totally absurd and imaginary and the OP raised the above bill foe wrongful gain, as nowhere it is mentioned in the yellow card meter reading is/was 80 unit on 14/03/2018, and immediately petitioner rushed to the OP No. 1 after received the above false/wrong/imaginary b ills and filed complained about the wrong bills and defective meter.

            That the petitioner several time requested to OP No. 1 about the defective meter and to review the old records of consumption then the average consumption will automatically come, but all are in vain, instead of that OP sent a message to the petitioner “to pay Rs. 38835/- within 28/12/2018 to avoid disconnection”.

            Hence this application for passing interim order of against the Ops not to disconnect the electric line of the Complainant.

 On careful scrutiny of the record and documents filed by the complaint we find substance that the complainant has got an exorbitant eclectic bill of Rs. 38,078/- which is very much more than his average eclectic bill.

            At this state without going into the merit of case we think electricity is most essential part of the human life in the present day situation and we think ends of justice would be met up if the Complainant is directed to pay lump sum amount to O.Ps and O.Ps are to direct not to disconnect the line.

 Accordingly prayer for interim order is allowed.

 

           

 

 

 

 

 

 

 

The Complainant is direct to deposit Rs. 10,000/- to the O.P No. 1 the W.B.S.E.D.C.L Murarai within 7 days from this day and the O.Ps are directed not to disconnect the Electric Connection of the Complainant being i/d No. 522129250.

            Deposited amount will be adjusted with Electric Bill of the Complainant.

            The Complainant is also directed to pay the current Bill month by month/ quarterly.

OP No. 1 is directed to raise average bill considering bill of previous year as per WBERC rules.

Thus the M.A is disposed of.

 Fixed 15/02/2019 for appearance of the O.Ps.

Interim order will be effective till 15/02/2019.

            The copy of the order be supplied to the parties at free of cost.

            The Copy of the order be sent to O.P No. 1 W.B.S.E.C.L Murarai through speed post for Compliance.

            Copy of this order be supplied to the parties each at free of cost.
