Hazira is filed on behalf of the complainant through advocate.
No step is taken by the O.P.
The case is fixed for argument.
After hearing argument the Commission proceeds to dispose of the case as hereunder: -
The complainant is a consumer under O.P. having SC No.LR/D/5034 and Consumer No.E290862 and has been regularly paying the electric bill sent by the O.P. Thereafter problem cropped up in the meter but without replacing the same the O.P. sent electric bill to the complainant on protest. Ultimately the O.P. disconnected the electric connection of the complainant for non-payment of the bills dated: 26-03-12, 21-12-12 & 19-06-13 showing total adjustment units 1217. New meter was installed on 27-09-2013.
Hence this case for restoration of electric connection on adjustment of the incorrect electric bills.

O.P. contested the case by submitting a written version denying all the material allegations made in the complaint and contending inter alia that the complainant has all along been sent correct electric bills showing the actual consumption and the adjustment units as shown in the disputed bill are the consumption units for the earlier period.
-:Decision with reasons:-
Having regard to the facts of the case and documents on record and the submission and contention of the complainant the Commission finds that the complainant has skipped payment of electric bill dated: 26-03-12, 21-12-12 & 19-06-13 on the ground of inclusion of adjustment units 1217. All the disputed bills date back to the Year 2010 to 2013 and there is no way out or mechanism for back calculation of the actual consumption. If the meter is defective reading is bound to be incorrect.
The meter having been changed on 27-09-2013 the meter reading thereafter can be relied upon to assess the average consumption for the disputed bill dated: 26-03-12, 21-12-12 & 19-06-13. There is no material on record from which the average consumption can be ascertained during the disputed period.
It is a fit case to apply Thumb Rule in order to render justice to the consumer by directing the O.P. to restore the electric connection of the complainant subject to payment of the disputed bill dated: 26-03-12, 21-12-12 & 19-06-13 together with adjustment units 250.
Accordingly it is ordered that the case be and the same is disposed of by directing the O.P. to restore the electric connection of the complainant subject to payment of the disputed bill dated: 26-03-12, 21-12-12 & 19-06-13 together with adjustment units 250 within a month from this date failing which the order may be executed in due process of law..
Both parties be supplied copy of this order free of cost.
