Today is fixed for hearing of petition dated 04-10-2016 filed by the Complainant.

Petition dated 04-10-2016 is taken up for hearing.
Heard both sides. Perused the petition and show cause.
Ld. Advocate for the Complainant argued that the O.P. has disconnected his service connection line and also refused to accept the current bill despite direction of this Forum. So, he prays for passing necessary order.
On the other hand, it reveals from the W.O. that O.P. has expressed his inability to restore service connection line of the Complainant for non-compliance of the direction made by the Hon’ble High Court, Calcutta on 16-12-2015 in W.P. No.26469(W) of 2015.
In reply Ld. Advocate for the Complainant argued that no such direction was made in the matter of deposit / payment as stated in the show cause / W.O. filed by the O.P.
We have carefully heard the submissions made by the Ld. Advocate for the both sides.
Perused the copy of the order dated 16-12-2015 passed by Hon’ble High Court, Calcutta in W.P. No.26469 (W) of 2015.
It appears from the order of the Hon’ble High Court, Calcutta that Hon’ble High Court, Calcutta has been pleased to pass the following order inter alia that –
“Upon the Petitioner paying Rs.20,000/- by 31st December, 2015, the respondent / license will reconnect his electricity supply within seven working days.
The balance amount of Rs.17,897/- should be paid in two equal installments by seventh of the month in February and March, 2016. The current dues should also be paid.
In default of any of these conditions the electricity connection of the petitioner is liable to be cut off.
The Writ Application is thus disposed of.”
In view of the above facts & circumstances we are of the opinion that this Complainant is bound to comply with the direction in the matter of payment of amount made by the Hon’ble High Court, Calcutta in the said writ.
Thereafter, O.P. is to restore service connection line.
We also found that order dated 16-12-2015 in the said writ petition was passed by the Hon’ble High Court, Calcutta with observation that this dispute is pending before this D.C.D.R.F., Bankura.
In view of the above facts & circumstances Complainant is hereby directed to comply with the direction made by the Hon’ble High Court, Calcutta dated 16-12-2015 in W.P. No.26469 (W) of 2015 at first after making deposit of the amount as per order of the Hon’ble High Court, Calcutta; then the O.P. shall restore electricity connection to the service connection of Complainant within the period as mentioned in the order passed by the Hon’ble High Court, Calcutta in said W.P.
Accordingly, this petition dated 04-10-2012 is hereby disposed of.

Let a plain copy of this order be given to the parties free of cost.
