ORDER

The application filed by the complainant Ramghati R.L.I against the O.P WBSEDCL for passing interim order U/s 13(3B) of C.P. Act, 1986 is taken up for hearing treating the same as M.A case No. 11/2018.

Perused the complaint, interim application and documents and W/V filed by the O.P.

We find that it is the case of the complainant that they are enjoying electricity in their organization situated at Ramghati, Dist. Birbhum being consumer ID No. 500566283 and has been paying bills regularly but by serving a notice dated 08.04.2017 the O.P informed that outstanding amount of Rs. 3,94,299/-  due in connection with said meter and directed to pay the same failing which the connection will be disconnected.

We find that the complainant is an organization which is supplying irrigation water to the agriculturist of the said village.

It is the case of the complainant that they never received such huge bill earlier and meter is defective one which is required to examine and remove.

It is the further case of the complainant that on 28.01.18 the O.P disconnected their line during pendency of the case, which is required to be restored.

On the other hand as per W/V it is the case of the O.P that they are ready to restore the line, if the complainant pays the outstanding dues.

From copy of the bill and money receipt we find that the complainant never paid such huge bill and it may be that the meter is defective.

Considering overall matter into consideration we find that at this stage for the befit of the agriculturist without going into the merit of the case, and interim order is to be passed on payment of lump sum amount of Rs. 60000/- by the complainant.

Hence

Ordered,

that the petition dated 02.032.18 filed by the complainant for passing an interim

 order for restoring their electric line being ID No. 500566283 i.e. M.A 11/18 is allowed on contest without any cost.

The complainant is directed to deposit Rs. 60000/- to the O.P as lump sum at once, which will be adjusted with actual bills.

The O.P is directed to restore the line immediate after such payment.

M.A. is disposed of accordingly.
