FINAL ORDER / JUDGEMENT

Both parties file hazira through advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder:-

The Complainant’s case is that previously he had a short term Submersible Pump (SMP) connection (vide Consumer I/D No.200507247) for which he already deposited Rs.3,000/- as service connection charges and Rs.5,014/- as Security Deposit under proper receipt. Thereafter he availed of the permanent  SMP connection  on deposit of requisite charges (vide Consumer I/D No.200693803). The Complainant has come before this Commission with the plea of refund of the earlier deposit for aforesaid short term connection according to the rule.

O.P. contested the case by filing a written version contending inter alia that the earlier deposit of short term service connection has already been adjusted with OSD at the time of final bill. Their further defence case is that an FIR has been lodged No. being Kotulur P.S. Case No.03/2020, dt.09/01/2020 with regard to the present SMP connection which now stands disconnected. The Complainant is therefore not entitled to get any relief in this case.

-: Decision with reasons: -

Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that according to the O.P. earlier deposit of short term SMP connection has been adjusted with OSD at the time of final bill but no document could be produced to that effect in course of hearing.

However it is an admitted fact that an FIR has been lodged in respect of the present SMP connection and the trial thereof is pending before the Special Electricity Court, Bankura. The Complainant is not entitled to get any relief of refund with regard to the SMP connection in view of the pendency of the criminal case of theft of electricity.                                                                                                                                         

                                                                                            Hence it is ordered……..

That the case is disposed of on contest by directing the O.P. to adjust the deposit of earlier short term SMP connection with the final bill if not already done in the mean time within one month from this date I/D law will take its own course.

Both parties be supplied copy of this Judgement free of cost.
