The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that he is a consumer with regard to his Submersible pump vide Consumer I/D No.20249963. Initially the Complainant was enjoying consumption through Single phase three meters bearing Nos. B2883532, B2883531 and B2872150 which were installed on 30/12/2017 and thereafter it was replaced by a Single Three phase meter on 01/10/2018 meter No. being GX070253. Be it mentioned here that the Complainant has not yet applied for TOD meter. The Complainant has approached this Commission disputing meter readings with regard to above mentioned Single three phase meter.
O.P. contested the case by filing a written version contending inter alia that the Complainant has an outstanding dues of Rs.1,42,526/- and LPSC Rs.56,769/- as on 27/09/2023 prepared out of the Single Phase three meters and Single Three Phase meter readings and the Complainant has paid Rs.31,300/- on 31/01/2022. The Complainant has to pay the balance outstanding dues otherwise he is not entitled to get any relief in this case.

-: Decision with reasons: -
Having regard to the facts of the case, submission, contention and documents from both sides the Commission finds that the Complainant has raised dispute with regard to the meter readings out of the Single Phase Three Meters but there is no mechanism to verify the meter readings for the above period. However, considering the facts and circumstances of the case the Complainant may be exempted from payment of LPSC of Rs.56,769/- provided TOD meter is to be installed at his own cost positively by April, 2024 but the Complainant is liable to pay Rs.1,42,526/- as the outstanding dues as on 27/09/2023.
With this observation the case is disposed of on contest by directing the Complainant to pay Rs.1,42,526/- to the O.P. along with Current electric bill if any positively by April, 2024. The Complainant will get the exemption benefit of payment of LPSC of Rs.56,769/- as directed above subject to installation of TOD meter at his own cost within the stipulated period i.e. April, 2024 otherwise he has to make the payment thereof to the O.P. within the same period.
Both parties be supplied copy of this Judgement free of cost.
