Both parties file hazira through Advocate.

The case is fixed for argument. After hearing arguments from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he applied for electric connection to his Submersible Pump on 18/11/2014 on deposit of Rs.5/- and Rs.200/- as Earnest Money on 30/03/2015. Though the O.P. surveyed the place of connection but did not send any Quotation. On 10/01/2015 a letter was sent to the Complainant by the O.P. stating that the connection is not techno-economically viable. The Complainant has therefore filed the instant case for connection to his Submersible Pump with compensation in accordance with law.

The O.P. contested the case by filing a written version stating that the electric connection as applied for is not techno-economically viable which was communicated to the Complainant by letter dated: 10/01/2015 but the Complainant never had any contact with the O.P. in the matter.

            -: Decision with reasons: -

Having regard to the facts of the case, contention and submission and documents on both sides the Commission finds that the O.P. Department has not refused electric connection to the Complainant but expressed their inability to give connection by letter dated: 10/01/2015 on the ground that the connection is not techno-economically viable. Though the said letter dated: 10/01/2015 is not on record but at the time of hearing Ld Advocate on both sides have acceded to this point. If the electric connection as prayed for by the Complainant is not techno-economically viable the Complainant has to take up the matter with the O.P. and it may be so that the Complainant will have to bear additional cost to make it viable for getting electric connection to the Submersible Pump of the Complainant. Without disposal of this matter the O.P. cannot send Quotation for installation of electric connection. The prayer of the Complainant should be considered by the O.P. in accordance with law by taking into consideration the viability of the techno-economical point in installation of the connection as prayed for and the Complainant must hold meeting with the O.P. in the matter and extend active co-operation to the O.P. Authority accordingly.

It is however made it clear that the Commission does not by this  letter insist the O.P. to make electric connection to the Submersible Pump of the Complainant economically viable beyond the scope of Electricity Rules & Regulations. In enforcing the Order of this Commission the O.P. Authority should consider the financial limitation of the Complainant.

With this observation the case is disposed of on contest by directing the O.P. to consider the prayer of the Complainant for electric connection to his Submersible Pump by sending Quotation as permissible and applicable to the present case within a month from this date in default the O.P. Authority may be subjected to suffer penalty in accordance with law.

Both parties be supplied copy of this order free of cost.
