Both parties filed hazira through advocate.
The case is fixed for argument.
After hearing argument / Written argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The complainant’s case is that he has applied for electric connection to his Submersible Pump (SMP) by paying Rs.200/- on 19-12-2011 as Earnest money and after long three years the complainant paid Quotation money of Rs.65,460/- on 07-01-2015 as demanded by the O.P.. The complainant is entitled to get the benefit of Clause-6 of WBSEDCL Procedures- A (2010) for which he has to pay Rs.4,000/- only applicable to connection charges for 3.75 KW and so he is entitled to get new connection to his SMP on refund of Rs.58,100/- as excess payment.
O.P. contested the case by filing a written version contending inter alia that according to the Office Order No.666, dated: 07-01-2013 the Quotation dt.12-11-2014 was served upon the complainant on his willing letter dated: 22-05-2014. The complainant is entitled to get new connection on turnkey basis i.e. at his own cost and as such he is not entitled to get any refund as claimed.

-:Decision with reasons:-
Having regard to the facts of the case, documents on record and contention and submission on both sides the Commission finds that the complainant is not entitled to get the benefit of Clause-6 of WBSEDCL Procedures- A (2010) as that scheme is not applicable to his case as he has opted for getting connection on turnkey basis on the basis of Office Order No.426, dt.08-04-2011 being the revised instruction related to WBSEDCL Procedures- A (2010) on which reliance has been placed by the complainant.
In view of the clear administrative Order the complainant is not entitled to get the benefit of refund of Rs.58,100/- but he is entitled to get the connection as applied for at the earliest.
Accordingly it is ordered that the case is disposed of by directing the O.P. to install electric connection into the SMP of the complainant within a month from this date in default the award may be realized in due process of law.
