Both parties file hazira through Advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he being a small farmer applied for electric connection  to his submersible pump for cultivation purpose on 30/03/2010 on payment of earnest money of Rs.1,000/- and thereafter the Complainant paid Rs.46,217/- to the O.P. on 23/12/2010 as quotation money but the O.P. has still failed to install electric connection to the Complainant as applied for. The Complainant has therefore approached this Commission for appropriate relief.

O.P. contested the case by filing a written version contending inter alia that they are ready and willing to install electric connection to the submersible pump of the Complainant subject to supply of all installation materials or costs thereof by the Complainant on Turn Key basis.

         -: Decision with reasons: -

Having regard to the facts of the case, contention, submission and documents on both sides   the Commission finds that the quotation dt: 27/12/2010  itself  shows that  service connection

materials are to be supplied by the consumer. According to WBSEDCL Procedure-A (2010) the consumer has to supply the cost of materials for installation of electricity which is known as Turn Key Contract but the Complainant has not complied with the same till now. So there cannot be any deficiency of service on behalf of O.P. in installation of submersible pump connection. The Complainant must supply the requisite materials or the cost thereof otherwise he will not be entitled to get the connection as applied for.

Hence it is ordered…….

That the case be and the same is disposed of on contest by directing the O.P. to install submersible pump connection to the Complainant subject to supply of materials or cost thereof under Turn Key contract within one month from the supply of requisite materials or cost thereof by the Complainant.

Both parties be supplied copy of this Order free of cost.
