The Complainant files hazira through Advocate.

No step is taken by the O.P.

The case is fixed for argument. After hearing arguments from the Complainant the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he got an electric connection to his Submersible Pump with Meter No.5640090 on 05/03/2013 and on inspection by the O.P. the Meter Reading was found 5281 Units on 28/04/2013 and 5551 Units on 21/07/2013 and the same Meter Reading was found on 09/11/2013 as the Submersible Pump was not in operation during this period but the Complainant received an electricity bill for the month of July, 2014 with the Consumption period of February, 2010 to January, 2014 for Rs.1,30,954/- with 31,709 Units as adjustment units. Challenging the said Bill the Complainant has approached this Commission for appropriate relief.

O.P. contested the case by filing a written version contending inter alia that the Bill in question is justified and rightly prepared taking into consideration the total units which were  consumed by the Complainant and prayed for dismissal of the case.

-: Decision with reasons: -

Having regard to the facts of the case, contention and submission and documents on both sides the Commission finds that the Complainant has not mentioned the fact of unmetered connection to his Submersible Pump way back in February, 2010 with same Consumer No.5640090. The disputed bill is based on the reading dates from 05/03/2013 to 25/06/2014 with the consumption period from February, 2010 by adding an adjustment unit of 31,709.

Ld. Advocate for the Complainant has raised objection to the disputed bill mainly on the ground of addition of adjustment unit of 31,709. But the Ld. Advocate for the Complainant has lost sight of a fact that the Complainant has been in enjoyment of the electric connection to the Submersible Pump since February, 2010 when it was under the scheme of unmetered connection but with the installation of the new Meter on 05/03/2013 Meter No. being RSSXC1046 the Complainant is liable to pay for the entire consumption of the back period since 2010 without any benefit from the unmetered scheme of electric supply and the disputed bill has been prepared taking into consideration the backlog of previous consumption bill and adjustment unit of 31,709 has been so added in the disputed bill.

The Commission finds nothing wrong on the part of the O.P. to raise such bill taking into consideration all the previous consumption of electricity enjoyed by the Complainant. The Complainant has filed the instant case in order to get undue benefit from the O.P.

Before parting with the order the Commission likes to place on record that in view of the  Clause-3.5 of Notification No.55 of West Bengal Electricity Regulatory Commission dated: 07/08/2013 the Commission is reluctant to interfere with such billing dispute but at the fag end of this case the Commission does not like to apply the same but to dispose of the case on merit in the interest of justice.

Hence it is ordered……..

That the case is dismissed on contest but without cost.

Both parties be supplied copy of this order free of cost.
