Today is fixed for W/V by O.P. 1 & 4 and exparte against rest O.Ps.

No step is taken by the O.Ps.

Ld. Advocate for the Complainant is present by filing his hazira and submits before us inter alia that the dispute as alleged in this case has been settled out of Forum. As such, Complainant does not want to proceed with this case.  So, he prays for dismissal of this case for non-prosecution.

Ld. Advocate for the Complainant also files also petition stating said facts this day.

Perused the petition and materials on record.  It appears that dispute as alleged in this case has been settled out of Forum.  As such Complainant does not want to proceed with this case and prays for dismissal of this case for non-prosecution and this fact has been conveyed to this Forum through his Advocate and his Advocate has made prayer for dismissal of this case.  One application has been filed by Complainant in this regard through Advocate.

In view of the above facts & circumstances we do not find any impediment to dismiss this case for non-prosecution on the basis of prayer made by Complainant through his advocate.

Hence, it is

That the Complaint Case no.05 of 2015 be and same is hereby dismissed for non-prosecution but without cost.
