Both parties filed hazira.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder.

The complainant’s case is that he is a consumer with O.P./WBSEDCL running temporary Submersible Pump (SMP) with the approval of the O.P. by paying electric bill from time to time under Consumer I/D 201461053 and Meter No.GX010637. He applied for permanent SMP service connection and duly deposited Quotation amount and Security deposit for the same. But subsequently he applied for withdrawal of permanent SMP connection and refund of Quotation money.

The O.P. has approached this Commission for appropriate relief with regard to SMP connection and the billing thereof.

The O.P. contested the case by filing written version contending inter alia that the complainant is continuing the temporary SMP connection without any dis-connection from the ends of O.P. and the O.P. is officially ready and willing to return the quotation money and other deposit relating to permanent SMP connection.

At the time of hearing Ld Advocate appearing for the complainant could not make out any case for redressal by this Commission. Admittedly the complainant is enjoying the temporary SMP connection and depositing electric bills from time to time. The complainant is not interested to have permanent SMP connection and he is entitled to get back the Quotation money together with Security deposit. The O.P. has nothing to interfere with the running of the temporary SMP connection. If any exigency arises in accordance with the Electricity Act and Rules & Regulations thereof, the O.P. is given liberty to effect permanent SMP connection to the complainant on payment of requisite fees and charges. As of now no Consumer dispute exists between the complainant and O.P. and the Commission is not inclined to pass any order at this stage.

Hence it is ordered……..

That the case is disposed of on contest but without cost with liberty given to the complainant to apply for permanent SMP connection on payment of requisite fees and charges as and when exigency arises and to enjoy the existing temporary SMP connection in accordance with law without any interference from the O.P. Authority.

Copy of this Order be supplied to both parties free of cost.
