Brief facts of the case are that Complainant / Petitioner is a consumer of OP Company and was enjoying Electricity for a long period being consumer ID No.312053561 and he was cultivating his land for getting water with the help of submersible pump availing the power from the OP Company. That the OP connected three Phase TOD meter in his submersible in the year 2008. Thereafter, OP changed the said meter by replacing single phase meter in the year 2011. And he paid the bills regularly. On June 2012 the OP changed the single phase meter by three phase meter without his knowledge. As the complainant being an illiterate person and taking that advantage the OP installed the meter which exists a huge units before the connection. During the monsoon season he received huge bills and he filed a complaint on 2.7.2012 in that regard before the OP. Without taking the recourse of his complaint the OP disconnected his power connection on 5.12.2012. Then he again filed written complaint on 18.6.2015 but till date they did not rectify the bills. According to the Electricity Act, during the replacement of meter the signature of the customer is mandatory in the yellow card but they did not do so. So, he is deceived by the OP as he is an illiterate person. He also suffered huge agricultural loss due to lack of electricity for three successive years. As such he prayed for cancelling the electric bills from June-2012 to December-2012 and demanded compensation for disconnection. He filed the instant complaint for compensation as he faced loss amounting to Rs.4,86000/-.
After getting notice from this Forum the OP did not turn up, so, the proceedings run ex-parte against the OP.
After perusing the case record, it is clear that the complainant lastly turned up on 11.3.2015 and thereafter was absent from the proceedings. This Forum directed the complainant to file show case as to why the complaint should not be dismissed due to non-prosecution. But no show cause was filed by the complainant. As such the next date was fixed on 29.10.2015 for passing final order.
After perusing the case record and considering the conduct of the complainant we are constrained to dismiss the complaint filed by the complainant due to non prosecution.
Let a plain copy of this Order be supplied free of cost to the parties/their Ld. Advocates/Agents on record by hand under proper acknowledgement/ sent by ordinary Post for information & necessary action.
