Complainant also files petition praying for interim order restraining o.ps., WBSEDCL, not to disconnect his electric connection. Let this petition be registered as MISC Case no. 51 of 2017. This MISC Case is taken up for hearing.
Ld. Advocate for the complainant submits before us interalia that he has challenged the bills for the month of October’17 to December’17 issued by the o.ps., WBSEDCL in favour of complainant. Now o.ps. are making threatening to disconnect his electric connection for non payment of the amount of disputed bill. So he prays for granting interim order restraining the o.ps. not to disconnect his electricity.
Heard. Perused the materials on record and the xerox copy of document and the petition of complaint. It appears from the petition of complaint that o.ps. have claimed Rs. 9,335/- for consumption of electricity by the complainant during the month of October, 2017 to December, 2017 and this complainant has filed this complaint challenging the said amount and he is apprehending that his electric connection may be disconnected for non payment of the bill for the disputed period. In view of the above facts and circumstances and considering the matter relating to disconnection of electricity we like to pass interim order restraining o.ps. not to disconnect the electricity subject to deposit of Rs. 5,000/- against the disputed period of bill.
Hence,
O R D E R E D
That the M.A. case no. 51 of 2017 be and the same is hereby allowed.
The o.p. no. 4, Station Manager, Dasnagar CCC, Howrah Division 1, WBSEDCL, is hereby restrained from disconnecting the service connection no. 1002061898, Installation no. 16130904, ID no. 101753741, Meter no. L 3999325 subject to deposit of Rs. 5,000/- by complainant against the amount of disputed bill provisionally by seven days from the date of receipt of copy of this order.
The o.p. no. 4 is also further directed to receive the amount of Rs. 5,000/- provisionally against the amount of bill for the disputed period subject to result of this case.
Interim order passed above will continue till next date of this complaint case i.e., 18.12.2017. Thus the MISC Case No. 51 of 2017 is hereby disposed of.
Let a copy of this order be served upon o.ps. for information and taking necessary action.
