JUDGMENT
Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;
“Direct the opposite parties to supply ration commodities in his ration card and compensated separately for mental agony and cost of litigation”.
Brief fact of this case is that complainant was given a ration card bearing No.12030510804 in the name of Jayanti Mohapatra but the case has been filed by Prakash Mohapatra, son of Golekh Mohapatra, name of Prakash Mohapatra is nowhere in the petition except in the cause title and verification and affidavit. It is claimed by the complainant that he has taken ration from the dealer from 25.01.2016 to 25.5.2016 and thereafter without assigning any reason the opposite party No.2 did not allowed the complainant to take the ration commodity for which entire family is suffering.
Neither the complainant has paid any consideration nor the PDS system is coming within the purview of Consumer Protection Act, 2019, as such there is no scope which empowers this Commission to interfere in the mater. Since the complainant has not paid a single pie as consideration we have no hesitation to dismiss the consumer complaint. Accordingly consumer complaint is dismissed. No cost.
