the above mentioned case was filed at district consumer dispute Redressal forum at Gurgoan on 06.08.2007. It was dismissed in default on 18.09.2009 at the then consumer forum at Gurgoan. The complainant moved an application though his counsel for restoration of the complaint on 30.09.2009 at Gurgoan because at that time there was no consumer fourm Mewat at nuh. then on 17.01.2011, the above mentioned complaint along with application was transferred to the present consumer form at nuh on 17.01.2011. the above mentioned complaint along with the application was presented to this forum but the quorum was incomplete and no decision could be passed on the application for restoration. now today i.e. 05/01/2015 , the complainant is present and forum is also complete. The application for restoration was considered and as per the decision of Hon’ble Apex Court in civil appeal no. 4307 of 2007 with Civil Appeal no. 8155 of 2001-Decided on 19.08.2011 in case titled Rajeev Hitendra Pathak and Others Vs. Achyut Kashinath Karekar and others,  the present fourm have no jurisdiction to recall its order dated 18.09.2009 passed by the then Consumer Court at Gurgoan. Hence the application for restoration is Dismissed. File be consigned to record room.
