ORDER

Order dt.29/08/1992 The complainant claims refund of Rs.18234/- which is deposited with respondent in intalments between August 1989 to January,1991 at the rate of Rs.1000/- PM under a housing scheme for purchase of BDA site at Bangalore. He states that he was not alloted any site at Bangalore and hence wants his amount to be refunded to him. Notice of the complaint was issued to respondent. Respondent appeared in person but did not file any counter. He was placed exparte. The petitioner has filed his affidavit to prove his case. Perused same and application. He says he is a heart patient and does not want to continue in the scheme. Hence, on this grounds and on equity and justice his petiton is allowed. The respondent shall refund the amount deposited by the complainant Rs.18,234/-. The Petitioner to get costs of Rs.200/- from the respondent. sd/- G.Vamdev President sd/- B.A.Hasanabba Member
