Even on the second call, counsel for the petitioner is not present. Dismissed for non-prosecution.
State Commission had dismissed the appeal as barred by limitation. There was a delay of 7½ months in filing the appeal. Under the Consumer Protection Act, consumer fora are supposed to decide the complaint within a period of 90 days from the date of filing if no evidence is required to be led and, in case, some evidence is required to be led, then within 150 days. Where the statute has permitted only 30 days for filing the Appeal, such an inordinate delay could not have been condoned until and unless some sufficient cause is shown, which the petitioner failed to show.
We agree with the view taken by the State Commission Dismissed.
