              This appeal is directed against the order dated 12.11.2009 passed by the
District Consumer Disputes Redressal Forum, Bhopal (for short ‘Forum’) in complaint case no.435/09, whereby the Forum has dismissed the complaint filed by the appellant / complainant on the ground that the same has been filed beyond the prescribed period of limitation.

             In the pleading of the complaint the appellant stated that the cause of action arose on 04.02.2002 thereafter again on 20.04.2006. The complaint was filed before the Forum on 17.04.2009.

              In the circumstances, the complaint in our considered opinion, has been rightly dismissed by the Forum, holding it to be barred by the limitation.    In addition, the delay of two months and 4 days in filing the appeal has also not been satisfactorily explained.

              Accordingly, on the ground of delay as also on merits, the appeal is dismissed.
