In view of order no. 19 dated 07.08.2023 of CC/74/2020, the application of complaint for adducing evidence on subsequent event is registered as MA/204/2023 and the said Misc. Case is taken up for hearing.

Heard both sides.

Complainant states that regarding the illegal bill of 12,868.51 Paise dated 30.01.2020, complainant initiated this case and subsequently the complainant received another demand letter issued by O.P. on 18.05.2023 demanding 11,242.56 and though relating to earlier bill, present case is pending and as such complainant would like to adduce further evidence. Considering the prayer of the complainant, it may be noted that as per complaint in the present case, cause of action arose on 02.12.2019 and thereafter again on 20.01.2020 and subsequently on 23.01.2020, 25.01.2020 and 30.01.2020.

Now at this juncture, complainant likes to add further evidence in view of new cause of action alleged to have been occurred on 18.05.2023. Obviously, this Commission will not allow the same for inviting new cause of action and if complainant has any grievance relating to new cause of action dated 18.05.2023 he may file different case in appropriate Forum/Court separately and as such the prayer of complaint is turned down.

Thus, the instant Misc. Case is disposed of.
