Facts of the case in nutshell:-

          Complainant was Deputy Manager, at SBI , A,D,B. Bolangir He has retired from his service due to superannuation  after  retirement for better future of rest part of his life, the complainant on dt. 25.11.2015 deposited a sum of Rs 30,49,338/- with the OP under STDR No. 35622976645 for two years and its maturity date was 25.11.2017 and the maturity value of the aforesaid  STDR amount Rs 36,25,727/- on dt. 27.11.2017 OP has paid only Rs 34,48,184/- to complainant deducting a balance amount Rs 1,77,541/- complainant when asked OP regarding payment of less amount to which Op stated that less amount because of deduction to words income tax and T.D.S. There after the complainant replied the Op that he himself has paid the income tax and  for non deduction of TDS he has deposited his income tax return, therefore the O.P should not be paid less amount than the maturity amount as reflected in the STDR Bond.

                After the aforesaid development  O.P. refund Rs 55,816/- thereafter to the complainant which he had deducted to words income tax and in this way the OP has paid a total sum of Rs 35,04,000/- to

the complainant and still with held Rs 1,21,725/- to words tax . Op has not paid the less amount of Rs 1,21,725/- in spite of complying the provisions of TDS and submitting of income tax return.

The complainant relied on Following Document –

1. STD Voucher.
2. Transaction  Enquiry .

                In the view of above in details , I observed that present complainant is succeed. Op does not show any interest or does not take any action claim by complainant and not appear before the commission and file their version. So OP is proceed with a  experte  because OP is failure to appear before in the given time period hence fails to take any action to represent his version.

                                                                                          ORDER

                I directed to OP to pay Rs 1,21,725/- along with interest @ 9 % per annum from dt.25.11.2017  and further Directed to pay Rs 30,000/-  towards compensation for mental agony and  Physical harassment and 3000/- for litigation expenses.

                This order may complied with one month from the date  of this certified copy . failing    which it shall make payment of amount mentioned above within 12 % interest per annum from date of filing the present complainant till realization.
