Final Order / Judgement

After hearing the Ld. Advocate appearing for the complainant it is found that the complainant has wanted to recover a sum of Rs. 85,000/- which was deposited by him during pendency of the Case at District Forum at Barasat.

It is in the Complaint that the said deposit was made in view of the order passed by the Hon’ble State Commission. But to come within the ambit of this Act, the complainant is required to buy any goods or hires or avails for any service for consideration or to allege unlawful trade practice etc. This is not a Forum meant for effecting recovery of any amount to which the complainant is entitled. On an overall consideration of the case of the complainant in the light of  the legal position we are of the view that the case is not maintainable. The complainant is neither a consumer nor has he set out any case of deficiency in service or defects in goods, hence the case is not  admitted.

It is order that the case be and the same is dismissed without being admitted.

Let plain copy be given to the parties as per CPR.
