          Shri Kapur points out that in O.A. No.201 of 2000 filed by the opposite party –bank against S&S Pharmaceuticals India Ltd., a settlement was arrived at between the parties and the O.A. was allowed in terms thereof by the Debt Recovery Tribunal by the order dated 4.10.2002. He points out that in the Compromise Deed, the complainant (respondent in O.A.) had undertaken that it would withdraw all the cases filed in different courts against opposite party no.1-bank and in view of that undertaking the present complaint is liable to be dismissed. Copy of the Compromise Deed in said O.A. No. 201/2000, affidavit filed in support thereto of Samit Gupta and order dated 4.10.2002 are at pages 500 to 502. It seems that the complainant filed an application at page 503 dated 21.10.2002 addressed to the Registrar of this Commission stating that the complainant is not wanting to pursue the complaint against the Bank and wished to withdraw it and complainant be permitted to be withdrawn. Having heard Shri Kumar and having considered the said terms of the Compromise Deed, affidavit, order and the letter dated 21.10.2002, we are of the view that present complaint deserves to be dismissed as withdrawn in view of the undertaking given by the complainant in said O.A. No.201 of 2000. Accordingly the complaint is dismissed as withdrawn. No order as to costs.
