Final Order / Judgement

12-07-2023 Present : Sh.Sahil Bansal, Counsel for the complainant.

This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

During preliminary hearing, counsel for the complainant has argued that complainant had opened an account with opposite party No. 1 and was issued one Rupay Debit Card valid upto 01/25. It is further argued that opposite party No. 1, at the time of opening of account, insured the account holder Devinder Kumar for Rs. 10.00 Lacs under the scheme with opposite party No. 2. It is further argued that Devinder Kumar was injured by stray animal on 23-1-2022 and succumbed to injuries on 5-2-2022. Intimation regarding death was given to the opposite parties and even legal notice was also got served but the opposite parties have not settled the claim.

We have heard learned counsel for the complainant and gone through the record.

A perusal of file shows that complainant submitted personal accident claim form on 20-7-22 and thereafter sent notice on 10-7-2022 but the opposite parties have not responded till filing of complaint nor settled the claim. This Commission is of the view that complaint is pre-mature at this stage. As such, without going into merits of the case, opposite parties are directed to settle the claim of the complainant within 45 days from the date of receipt of copy of this order. As such, complaint stands disposed off.

Copy of order be issued to complainant free of cost and file be consigned to record room.
