This complainant’s appeal is directed against the order dated August 11th, 2016 passed by District Consumer Disputes Redressal Forum, Sirsa (for short ‘District Forum’), whereby complaint was dismissed.
2. Sanjeev Kumar-complainant filed complaint under Section 12 of the Consumer Protection Act, 1986 before District Forum alleging that he deposited a cheque dated May 12th, 2012 of Rs.95000/- issued by Jaswinder Singh in State Bank of India, Mini Secretariat Branch, Sirsa. The cheque was sent to State Bank of India, Ganga Nagar for its clearance but it was dishonored due to insufficient funds. The cheque was never returned to the complainant.
3. State Bank of India and its functionaries-opposite parties filed written version alleging therein that the cheque alongwith memorandum attached with it sent by State Bank of India, Ganga Nagar was returned to the complainant on 18th June, 2012.
4. A perusal of the Acknowledgment Book (Exhibit R2) shows that on 18th June, 2012 State Bank of India, Sirsa returned the cheque to Sanjeev Kumar-complainant and he acknowledged the same. In view of this, the impugned order passed by the District Forum is perfectly right and requires no interference. The appeal is dismissed.
