Present:       Sh. Naveen Sharma, Adv. for the complainant.

 

ORDER:-   

1.                Heard.

2.              Husband of the complainant had expired on 5.7.2018. During his service, in his life time, opponent provided Defence Salary Package (DSP) and opponent provided him insurance cover up to Rs.5,00,000/- under this salary package policy. She lodged her claim with the opponent and submitted all the requisite documents but the opponent has not settled her claim. She in Para No.6, nowhere pleaded on which particular date, she submitted documents with the opponent, nor receipt in this regard has been placed on record, then, she gave legal notice upon the opponent on dated 29.3.2023 and in the legal notice she also has not mentioned any date of submission of documents and particulars of documents.

3.              Prima-facie complaint of the complainant appears to be pre-mature. However, in order to maintain the balance, in case, time bound directions, are given to the opponent to settle the claim of the complainant, under Defence Salary Package Policy, in time bound manner, in either way, it will suffice the purpose and ends of justice will meet.

4.               Since, at this stage, no adverse order is being passed against the opponent, therefore, opponent is not required an opportunity of being heard.

5.               Hence, this complaint is dismissed, being pre-mature. However, the opponent is directed, on receipt of claim paper, from the complainant, it will settle the claim of the complainant, by passing speaking order, within the period of one month, from the date, when claim papers are received from the complainant and on  settlement of the claim of the complainant, in either way, by the opponent within the stipulated period as mentioned here-in-before or non-settlement of the claim by the opponent within the stipulated period, if the complainant feels aggrieved, she may file fresh complaint, against the opponent and in the fresh complaint, complainant will disclose the particulars of this complaint and its fate. Complainant will submit her claim paper, with the opponent within the period of 10 day, from the date of order, either by hand or through registered post. Complainant is directed to transmit the certified copy of this order to the opponent, either by hand or through registered post or any other legal mode of service, at her own responsibility.

6.                File be consigned to the records.
