The complainant has filed this case U/s 35 of the C.P Act,2019 to the effect that she is the widow of Khosh Mohammad who was a Railway employee retired on 30/10/1981 and died on 03/01/2005 and thereafter, the complainant is a family pension holder and her pension savings bank account number 34788946639 is under State Bank of India, Kaliyaganj Branch, Uttar Dinajpur. It is the case of the complainant that the O.P.Nos-2 & 3 that is the Assistant General Manager, Centralised Pension Processing Centre and Branch Manager, State Bank of India, Kaliyagnj Branch deliberately stopped the fixed medical allowances benefit on different questions and the O.P.No-3 / State Bank of India has been deducting Rs.3510/- in every month from her pension amount as excess payment. She has filed the copy of report of RTI given by State Bank of India and Advocate’s letter to the O.Ps and Xerox copy of PPO issued by PPO Issuing Railway, North East Frontier Railway, Maligaon, Guwahati, Assam. From the report of RTI and the Advocate’s letter dated.07/07/2020 it appears that the excess payment of medical allowances has been deducting from the pension amount in every month and in PPO Number:-KIR/PN/2299 issued with signature date 08/02/2016 is subsequent to 21/04/1999 without mention for payment of fixed medical allowance and moreover, the new PPO Number:-19817050200064 dated 24/01/2019 is not specific for payment of fixed medical allowance and the matter has been taken up with the Pension Sanctioning Authority (PSA) seeking necessary clarification in this regard, which would be acted upon on receipt of clarification of them and the Advocate’s letter also disclosed that the matter is pending before the Pension Authority for consideration. The complainant could not produce any document to show that the O.P.No-3 deliberately was/is not giving the fixed medical allowance though there was order for giving the same. From the documents so filed it appears that the matter is under consideration of the O.P.No-2. Therefore, it can be said that the complainant being the family pension holder is not the consumer under Pension Department of the Railway and the complaint does not specifically disclose that she hired the services of the Pension Department. As such, the complaint is not maintainable in this Commission. The complaint is not admitted.
