Per Shri S.R. Khanzode – Hon’ble Presiding Judicial Member:

 

 

     This appeal pertains to alleged deficiency in service on the part of the Respondent/Opposite Party.  As per the submissions made by Counsel for the Appellant/original Complainant the credit card was stolen and intimation was given on 25th August, 2006 around 05.30 p.m. by e-mail about loss of the card.  However, there is a dispute about this, Forum below, on facts, held that, such intimation was given not before 13.09.2006.  We find no fault with it.  Learned Counsel for the Appellant could not show us that the disputed use of the credit card was after the intimation.  In the circumstances, no service deficiency in service could be alleged on the part of the Respondent Bank. Since, the transactions are authorized through electronic media, there arises no question relating to verification of the signature.  Besides that, Forum below had also observed that, no such evidence has been adduced before it to substantiate said grievance.  Considering these aspects, we find that appeal is devoid of any substance and there is no point in disturbing the order passed by the Forum below.  Hence, we pass the following order:

 

O  R  D  E  R

 

     (i)       Appeal stands dismissed in limine.

 

    (ii)       No order as to costs.
