Parties are present through their respective ld. Advocates by fling haziras. Today is fixed for filing written version by the Op. The complainant has filed one settlement petition stating that as the dispute has been redressed and settled by the Op amicably out of court he is not willing to proceed further with this complaint and prayed for dismissal of the complaint.  Today the Op has filed one application along with a Banker’s cheque in favour of the complainant drawn on State Bank of India dated 12.4.2016 to the tune of Rs. 52,759=00. Simultaneously the complainant has prayed for withdrawal of the said Banker’s cheque from the custody of this ld. Forum and has submitted the original voter identity card along with its photocopy. After comparing the photocopy, the original card is returned to the complainant. Hence, the office is directed to hand over the said cheque to the complainant as early as possible. In our view as the complainant is not willing to proceed with this complaint because the dispute has been amicably settled out of court by the Op hence, the complaint be dismissed for non-prosecution. Hence, it is

that the Consumer Complaint being no. 20/2016 is hereby dismissed for non-prosecution.

            Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
