            Today is fixed for hearing the petition dt. 01.04.2022 being M.A. Case being No. 01/2022, objection if any, in the meantime.

            The complainant files hazira through the Ld. Advocate. Op No.1 also files hazira through the Ld. Advocate. OP No.2 also files hazira through Ld. Advocate.

            M.A. Case being No. 01/2022 is taken up for hearing and order.

            On 01.04.2022 the OP No.2 has filed a petition supported by an affidavit praying for expunging the OP No.2 from this case on the ground that the ATM in question wherefrom the cash was collected as alleged, from the Sadarghat Branch of Punjab National Bank (P.N.B) and the said ATM is not within the jurisdiction of the OP No.2. It falls under the jurisdiction of the Punjab National Bank (Sadarghat Branch).

            Ld. Advocate for the complainant has argued, though not filing any W.O that it was not possible for the complainant to know the ATM in question    falls under what jurisdiction of the branch of the said Punjab National Bank. But when the OP No.2, on affidavit, submitted that the ATM falls under the jurisdiction of the PNB-Sadarghat Branch, it would be a proper and necessary party.

            Accordingly, the prayer of the OP No.2 is considered and allowed.

            Let the OP No.2 be expunged from the Cause Title of the complaint.

The complainant is directed to take necessary amendment of the complaint in the matter by the date fixed.

            To 27. 07.2022 for taking necessary steps by the complainant for necessary amendment of the Cause Title of the Case.
