This case is fixed for Hearing on Admission today . Complainant is absent on call . No step taken by him . In the last date also he was absent . Perused the complaint petition . In Para 2 of his complaint petition the complalinant has averred that the cause of action of his case arose on 19/05/2015 . So the complaint case ought to have been filed within a period of 2 years from that day . But the complaint case has been filed on 24/09/2018 . So the case is barred by limitation .

                    The complaint have averred that he had sent demand notice to the O.P. on dt.07.07.2015 & 14.11.2017 . In the case of Niloba Ghanashyam Niak & others Vrs. Lodha Pranik Developers Pvt. Ltd. & others 2014(2) CLT 468(N C) the Hon’ble National Commission has held-“ It is well settled that the correspondence representations & Legal Notice do not extend the time of limitation”.

                   For the reasons stated Supra we are not inclined to admit this complaint case . However the complainant is at liberty to approach any other appropriate Forum jfor the redressal of his grievances if so advised . 

                         This complaint case is rejected .
