This appeal was received by Post.

           It has been filed against the order dated 9.06.2010 passed in C.C. No. 197/2009 by the Learned District Forum, Ranchi dismissing the Complaint  interalia on the grounds-that the Complainant  himself was responsible for  negligency in not closing the ATM Machine and withdrawing his password before leaving the ATM Booth, taking advantage of which some other person operated the machine and withdrew Rs. 40,000/- from the account of the Complainant, about which he learnt within 5 minutes, but he did not stated that he rushed  to the ATM Machine in search of that person or had informed the police about the crime.

          This appeal has been filed after about 6 ½ years on the grounds that the Complainant moved the District Forum, again after passing of the impugned order, by post, when by letter dated 1.09.2014 he was advised to file appeal before this Forum, and then he moved this Forum on 12.09.2014 through post on which he was asked to prefer appeal along with the copy of the order under appeal, by letter dated 16.10.2014.

          According to the Complainant, in another C.C. No. 214/2009, relief was granted, to another Complainant, but it appears from that order that facts and circumstances of this case are absolutely different from that case.

          Firstly there is no satisfactory explanation for condoning the long delay of 6 ½ years and secondly, we do not find any merit in this appeal.

          Accordingly it is dismissed.
