Appellant is absent. None for the respondent is present. On 09/08/2012 notice was issued to both the parties but no report about service of notice is received. However, Chief Manager of respondent-Bank by E-mail informed that he has received the notice and he will attend this Commission at 3.30 p.m. but till 5.00 p.m. nobody for the respondent-Bank turned up.

The office copy of the notice reflects that it was issued on the correct address of the appellant as shown in the appeal memo as well as in complaint. Therefore it will have to be presumed that the appellant is served with notice but he is absent. Hence, the appeal deserves to be dismissed in default and accordingly it is dismissed. No order as to cost.
