O R D E R

Parties represented. Parties to the complaint filed a joint statement stating that the matter has been settled between the parties on the following terms and conditions :-


 

  1. The opposite parties agreed that the construction of the flat will be completed and handed over the same on or before 31st July 2011.

  2. The opposite parties agreed that rent compensation for the delay in handing over the flat @ Rs. 1,856/- per month will be paid to the complainants till handing over the flat.

  3. The opposite parties failed to pay the rent compensation from March 2009 and agree to adjust the rent compensation arrears from March 2009 to December 2010 and future rent compensation till the handing over of the flat against electricity and water connection deposits, one time building tax, service tax and registration charges etc.

  4. Both the complainants and opposite parties mutually agree that after adjusting the rent compensation arrears, if any amount is due to either parties the amount will be paid by respective parties.

  5. It is mutually agreed that if the opposite parties fail to complete the construction of the Flat No. 'B' in floor No.3 of Block No. 31 of Star Apartment Annex, Thripunithura with electricity and water connection and to handover the same on or before 31st July 2011, the opposite parties shall repay to the complainants the entire flat cost of Rs. 4,95,000/- (Rupees Four lakhs ninety give thousand only) and rent compensation arrears at the rate of Rs. 1,856/- per month till 31st July 2001.

  6. It is also mutually agreed that if the construction of the flat is not completed and hand over the same on or before 31-07-2011. The opposite parties shall pay a compensation of Rs. 75,000/- (Rupees Seventy five thousand only) in addition to rent compensation to the complainants.

  7. Both the parties mutually agree that if either party fails to perform any term of the settlement, this term of settlement can be executed through this Hon'ble Forum.


 

2. In view of the above settlement between the parties, the proceedings in this complaint stands closed.
