Prem Singh Versus Star Health.

 

Present:       Complainant in person with Shri Sushil Garg, Advocate.

                    Shri Naveen Kr. Kaushal, Adv. for the respondent No.3.

                                                                            

                   On the basis of joint application filed by the complainant and the respondent No.3, file taken up on today as both the parties have entered into compromise. Counsel for the respondent No.3 suffered separate statement, according to which, respondent No.3 agree to make payment of Rs.1,79,000/- against claim No.904348 and Rs.74,000/- against claim No.649127, total amounting Rs.2,53,000/- within the period of 45 days from today. Complainant by making separate statement agreed to the version of the counsel for the respondent No.3.

                   Hence, in view of the statement of counsel for respondent No.3, without commenting anything on the conduct of either of the parties, the present complaint as a matter of amicable settlement, is accepted against the respondent No.3. The respondent No.3 is hereby ordered to make the payment of total amount of Rs.2,53,000/- (Rupees two lacs fifty three thousands only) as mentioned hereinbefore, within the period of 45 days from today, to the complainant, in default of it, respondent No.3 shall be liable to pay interest @7% per annum from the date of order till actual realization. File be consigned to records.
